Shipper Liability Policy

ATE does not provide cargo liability or all-risk insurance above the established $100 limit as referenced on ATE delivery tickets. Sender/shipper may pay an additional fee for declared value for carriage above these referenced limits at a rate of .35 cents per $100 value of additional coverage with a maximum of $ 50,000.00.Customers placing online orders must directly contact Customer Service to purchase additional insurance, as applicable, prior to the order being dispatched.

The insured declared value for carriage of any order represents ATE’s maximum liability in connection with a shipment of that order, including but not limited to, any loss, damage, delay, misdelivery, any failure to provide information, or misdelivery of information relating to the shipment. Exposure to and risk of any loss in excess of the declared value for carriage is assumed by the shipper/sender. Customers are advised to contact their insurance agent or broker for insurance coverage. Even if the higher value is declared, the liability of ATE for loss of or damage to the contents of a shipment will not be more than the actual value of the shipment and ATE shall be entitled to require independent proof of the value of the contents of a shipment for which a claim is made. In any event, this liability shall not exceed the equipment repair cost , depreciated value or wholesale replacement cost , whichever is less. ATE will not be liable in any event for consequential or indirect losses or damages , including but not limited to loss of income or profits. Claims must be filed within 24 hours of completed shipment. ATE will not be responsible for concealed damages or internal piece counts of skidded /wrapped pallets that do not show signs of outward damage upon delivery. This damage must be noted upon ATE delivery ticket and BOL prior to driver release.

ATE will not be liable for, nor shall any adjustment, refund, or credit of any kind be made as a result of any loss, damage, delay, misdelivery or non-delivery as a direct result of failure by the shipper/sender to package the material shipped in a manner adequate to protect it from damage. This includes original factory packaging and crating to protect the contents during shipping. ATE does not provide packaging or crating for shipments.

This policy supersedes any agreement, conditions or statements on the BOL, manifest or customer shipping document and may only be adjusted by written agreement with ATE Owner, General Manager or Operations Manager. Any decision by ATE to pay claims of any amount to any customer does not constitute acceptance of liability or establish precedence for payments made above the referenced limits.
